ReachIQ Terms of Use

Welcome to ReachIQ. When you download, install, or use NFC Writer by ReachIQ and any related services (collectively, the "App"), whether as a guest or a registered user, you are agreeing to the following Terms of Use. Please take a few minutes to read through them carefully.

Acceptance of Terms

By using the App, you confirm that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree, you must not use the App. ReachIQ reserves the right to update these Terms of Use at any time. Continued use of the App after any changes constitutes your acceptance of the new terms.

Eligibility

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms of Use.

Account Registration

To access certain features of the App, you will need to create an account. You agree to:

  • Provide accurate, complete, and current information during registration
  • Keep your login credentials secure and confidential
  • Notify us immediately if you suspect unauthorized access to your account
  • Take full responsibility for all activity that occurs under your account

You may not create an account on behalf of another person without their consent, or transfer your account to any other person.

Data Collection and Privacy

By using ReachIQ, you acknowledge and consent to the collection and storage of the following personal information:

Account and Onboarding Data During the onboarding process, we collect your information progressively across multiple steps, including:

  • Full name
  • Email address
  • Contact/phone number
  • Professional title
  • Social media profile links (LinkedIn, Instagram, Facebook, TikTok)

Profile Picture Any profile picture you upload is stored securely on our servers. By uploading a photo, you grant ReachIQ the right to store and display it within the App for the purpose of your digital contact card. You are responsible for ensuring you have the right to use any image you upload.

Card Analytics We collect and display analytics related to your digital contact cards, including the number of times your card has been viewed. This data is used solely to provide you with insights into your card's performance.

This information is collected solely to create and manage your digital contact cards and to power the NFC read and write features of the App. We will not sell or share your personal data with third parties without your explicit consent, except as required by law. For more information, please refer to our Privacy Policy.

NFC Features

ReachIQ allows you to write contact information to NFC cards and read data from NFC cards. By using these features, you agree to:

  • Only write accurate and truthful contact information to NFC cards
  • Not use the NFC write feature to store malicious, harmful, or illegal content on any NFC card
  • Not use the NFC read feature to access or collect data from NFC cards without the owner's consent
  • Not use the App to scrape or collect contact data from other users without their explicit permission
  • Take full responsibility for any content you program onto an NFC card using ReachIQ

ReachIQ is not responsible for any data stored on third-party NFC cards read through the App. NFC functionality is dependent on your device's hardware and software capabilities. ReachIQ does not guarantee NFC compatibility with all devices or card formats.

Digital Contact Cards

ReachIQ enables you to create and manage multiple digital contact cards containing your professional information. You acknowledge that:

  • You may create and store multiple cards within the App under the My Cards section
  • You are solely responsible for the accuracy of the information on each of your digital cards
  • You must not impersonate any person or misrepresent your identity or affiliation on any card
  • ReachIQ is not responsible for how recipients use the contact information you choose to share
  • You can update or delete any of your digital cards at any time through the App

Push Notifications

By creating an account and using the App, you agree to receive push notifications from ReachIQ. These notifications may include:

  • Platform news and updates
  • New features and announcements
  • Tips and best practices for using ReachIQ

These notifications function as a newsletter to keep you informed about the ReachIQ platform. You may opt out of receiving push notifications at any time through your device settings. Please note that opting out may mean you miss important platform updates.

Acceptable Use

You agree not to use the App to:

  • Engage in any unlawful, harmful, fraudulent, or deceptive activity
  • Store or transmit malicious code, viruses, or harmful software via NFC or any other feature
  • Harvest or collect contact information from other users without their consent
  • Impersonate any person or entity
  • Violate any applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the App or its infrastructure
  • Interfere with or disrupt the integrity or performance of the App

ReachIQ reserves the right to suspend or terminate your account if you violate any of these terms.

Intellectual Property

All content, design, graphics, and technology within the App are the property of ReachIQ and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App without prior written permission from ReachIQ.

User Generated Content

In these Terms of Use, "User Generated Content" refers to any text, contact information, and images that you submit to the App. You grant ReachIQ a worldwide, non-exclusive, royalty-free license to store, display, and use your User Generated Content for the limited purpose of operating and improving the App.

Your User Generated Content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action. We reserve the right to remove any content that violates these Terms of Use.

Third Party Links and Platforms

The App may contain links to third-party social media platforms including LinkedIn, Instagram, Facebook, and TikTok. ReachIQ is not responsible for the content, privacy practices, or terms of any third-party platforms. Your use of those platforms is governed by their respective terms and policies.

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. REACHIQ DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. REACHIQ IS NOT RESPONSIBLE FOR ANY ISSUES ARISING FROM NFC HARDWARE COMPATIBILITY, DEVICE LIMITATIONS, OR THIRD-PARTY NFC CARD FORMATS.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, REACHIQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF CONTACT DATA, NFC CARD MALFUNCTION, OR UNAUTHORIZED ACCESS TO YOUR DIGITAL CARD INFORMATION. REACHIQ'S TOTAL LIABILITY TO YOU UNDER ANY CIRCUMSTANCE SHALL NOT EXCEED $100.

Indemnification

You agree to indemnify and hold harmless ReachIQ and its affiliates, officers, agents, and employees from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your digital card content, or your violation of these Terms of Use.

Termination

ReachIQ reserves the right to suspend or terminate your access to the App at any time, with or without notice, for any violation of these Terms of Use or for any other reason at our sole discretion. Upon termination, your right to use the App will immediately cease.

Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the State of Washington.

Changes to These Terms

We may update these Terms of Use from time to time. We will notify you of any significant changes by updating the date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.
